Please read these Terms and Conditions carefully. These Terms govern your access to this site, as well as all sales of our products and services. PrintSale.ca from time to time may update these terms and conditions without notice to you. The terms existing at the time of purchase shall apply regardless of subsequent revisions. By continuing to access our website, or through the purchase of products and services, you agree to be bound by the terms and conditions set forth in our terms and conditions. If you use this service on behalf of any business, organization or other entity of any kind, you represent and warrant that you are authorized to accept these terms and conditions on its behalf and to bind such business, organization or entity to these terms and conditions.

GENERAL LIMITATIONS: All website contents are copyright ©PrintSale.ca, a division of Xeon Media Inc. All rights reserved. Prices, estimates, promotions, offers, and estimated delivery dates may change without notice. PrintSale.ca reserves the right to modify or discontinue any production or service without notification. PrintSale.ca shall not be liable to you for any loss or damage you may suffer due to any modification or discontinuation of any product or service. PrintSale.ca cannot be held responsible for pricing discrepancies due to errors in website functionality. Taxes and shipping costs are additional unless explicitly indicated on your quotation. All registered trademarks and trademarks are the property of their respective owners. All estimates are valid for 30 days from the estimate date and do not include taxes or shipping costs. Prices, specifications, and offers are subject to change at PrintSale.ca’s discretion. Allow ±2% difference for the finished trim size, Allow ±5% difference for over and under runs. Allow up to a 5% variance in colour. Allow up to a 5% variance in shift (in any direction) from automated trimming. Payment, in full, for printing services is required at the time the order is placed unless design services are ordered. If design services are ordered, pre-payment is only required for the design services at the time of sale. The remaining balance (for the printing) is required upon approval of the design work and before production can begin.

REGISTRATION: In order to take advantage of the full functionality of this Website and to order products and services it will be necessary for you to register and establish a membership account with PrintSale.ca. In the event that updated, new, additional and/or enhanced features are added to this Website, previously registered users will not generally be required to re-register, however, you may be required to re-acknowledge these Terms and Conditions and/or other terms and conditions that may accompany these new features, updates and/or enhancements.

When you register, you agree to provide accurate and current information about yourself (and your company) as requested during the registration process. You also agree to update and maintain your account information so that it remains accurate and current.

As part of the registration process, you will be required to create a User ID and choose a password. It is your responsibility to choose an appropriate password and to keep it confidential. You are responsible for all activities that occur under your User ID and password. If you believe your User ID/password has been compromised in any way you should immediately change it by logging on to your account and then following the instructions for changing your password. You agree that you will immediately notify PrintSale.ca in the event you become aware of any unauthorized use of your user ID and password.

DESIGN SERVICES, EDITS & CHANGES: Design service constitutes any work that is created, edited, or modified by a member of PrintSale.ca and is subject to a design charge at the current rate with a minimum billing of 1-hour. Additional time is billed in 0.50 (1/2) hour increments. All modifications, edits, proofing, revisions are billable services. Discounts may be provided on edits or modifications to files that we have previously billed for design services.

CUSTOMER SUPPLIED PRESS READY ARTWORK: Press Ready Artwork are files that are submitted by the customer that require no edits, modification or additional pre-press work before proceeding to production. Modifications to provided files may be possible at additional cost. PrintSale.ca cannot guarantee that modifications are possible on all files that are provided. PrintSale.ca does not check any provided files for spelling, grammar, or critique the design and its layout. It is your responsibility to ensure that all materials submitted for printing are formatted correctly.

UPLOADING FILES: PrintSale.ca has developed an interactive file uploading tool to expedite the proofing process. Customer will need to sign off on the online proof and any warnings (RGB colours, low quality images) before proceeding to ordering the file. It is solely the responsibility of the customer to carefully review any uploaded files to ensure that all content is correct. PrintSale.ca cannot and will not take any responsibility for any errors or omissions in files that are provided from clients and will not be liable for any such errors. PrintSale.ca does not check any provided files for spelling, grammar, or critique the design and its layout. PrintSale.ca has a file maintenance program that remove customer uploaded files within certain amount of time. We do not store or provide file storage services. It is your responsibility to keep your files on your local computer.

EMAILED PROOFS: For the products that may not have option for an interactive file uploading tool, the url link to the online proof will be emailed to customer. Customer will need to review and sign off on the online proof before order will proceed into production. New estimated time of product arrival will be generated after the online proof is approved. While interactive file uploading tool is good for identifying basic issues with the file our pre-flight team will also perform a file check before file proceeds into the production. In the event of major issues with the file or we may require additional confirmation from you, we may email you the link to the online proof with the details. Please note that delaying approving the online proofs will delay the completion of your project. PrintSale.ca will not be liable for any of delay in completing orders due to delay of approving the proofs.

COLOUR: PrintSale.ca will print your order in accordance with CMYK industry standards for pleasing colour. We offer no guarantee of colour matching and cannot prevent slight colour shift throughout an order or maintain colour fidelity from previous or subsequent orders. PrintSale.ca does not guarantee that colours will match the proof as it appears on a customer's monitor, because monitor colours vary. PrintSale.ca cannot take any responsibility for any color shift that occurs in conversions from RGB or PANTONE to CMYK color modes. PrintSale.ca cannot take any responsibility for errors in colours that occur from embedded profiles, transparency or other design definitions.

PHOTOGRAPHS, IMAGES AND GRAPHICS: PrintSale.ca makes every attempt to ensure that only royalty free images are used in its custom designs. PrintSale.ca, its officers, employees, directors and suppliers, will not be held liable for any damages, costs and expenses, including legal fees, arising out of or related issues of copyright or trademark infringement. It is understood that all files that are provided to PrintSale.ca – including images, logos, graphics and other potentially copyright elements and materials are legally allowed to be used and that the client will take all responsibility for any claims of copyright infringement regarding such supplied elements.

CLAIMS PERIOD: Claims for defects, damages, and/or excessive shortages must be made by the client in writing within a period of five (5) days after delivery of all or any part of the order. Failure to make such claim within the stated period shall constitute irrevocable acceptance and an admission that they fully comply with terms, conditions, and specifications.

PRODUCTION TURNAROUND: During the ordering process, PrintSale.ca will provide you with the estimated time of arrival (ETA) of your product if ordered, approved and paid on that day. ETA is an estimate only and does not guarantee the delivery of the product by that time. PrintSale.ca will not be Custom product turnaround times will vary depending on the level of finishing that is required. At the time that a quote is provided, an estimated turnaround time may be provided. All estimated production times are provided in business days. Business Days are considered to be Monday through Friday. PrintSale.ca does not consider weekends (Saturday or Sunday), as well as holidays to be considered as business days with consideration of production turnaround times. Delivery estimates are based on information provided by our courier partners. PrintSale.ca will not take responsibility for factors that are beyond our or our courier partner’s control (ie. Force Majeure or Acts of God). Production turnaround times that are provided by PrintSale.ca come into effect only after the client has emailed their approval of an electronic proof, has given written approval to proceed as is and payment for the printing services are paid for in full. RUSH services that deviate from our standard production times are available on most products for an additional charge. PrintSale.ca will not be liable for any order delays due to manufacturing equipment malfunctions, delayed proof approval or delayed receiving payment for the order.

PAYMENT: PrintSale.ca requires a full payment in order to release an order to production. All orders that are not paid for will not be able to proceed to production. PrintSale.ca will not be liable for any of delay in completing orders due to your delay in payment. PrintSale.ca does not accept cheques.

REFUNDS: PrintSale.ca is committed to providing our customers with quality printing and design services. If in the event that there is a problem with an order, you must bring it to our attention within 5 business days. As printing is custom manufacturing, all sales are considered to be final. PrintSale.ca will not take any responsibly or incur any costs for reprinting or refunding any errors that were present in the online proof. In the event of a production or finishing error, PrintSale.ca will make every attempt to correct the error. If the error is not correctable, it will be at the sole discretion of PrintSale.ca management to reprint or refund any order based on the circumstances of said order.

TRANSFER OF TITLE: The client agrees that the shipping terms for all printed products are FOB shipping point and ownership transfers to the customer upon shipment.

SHIPPING: PrintSale.ca offers printing and shipping locations across Canada and the United States. While we make every attempt to ship from the location nearest you, your order may come from any of our locations or affiliate locations. Delays can occur depending on your country of origin due to customs. PrintSale.ca is not responsible for any delay caused by customs. PrintSale.ca utilizes third-party carriers to deliver orders and it is not liable for delivery problems. PrintSale.ca cannot make any guarantee over which delivery service is used to deliver your order. PrintSale.ca makes no guarantee about time in transit of any shipping method. PrintSale.ca will provide an estimated transit time and will contact you when your order is in transit with an expected delivery date. If you do not receive an order by the expected delivery date, or it arrives damaged, you should contact PrintSale.ca immediately so that we can investigate the matter.

SHIPPING METHODS: PrintSale.ca employs a “best carrier” policy. Your order will be shipped in the most efficient method to both keep cost to a minimum and to ensure timely delivery of your printing order. We use reliable carriers such as FedEX, UPS, Purolator, Canpar, Loomis and DHL for courier services. Canada Post and USPS are used for mail parcel services to rural areas. For larger orders, requiring freight, we may use companies like Canadian Freightways, Day & Ross, FedEX Freight and UPS Freight.

SHIPPING TIMES: Shipping times are provided by the various carriers that we use and PrintSale.ca cannot make any guarantee as to the actual delivery date due to circumstances that are outside of our control. Standard delivery service will have orders delivered to most urban centres within 5 business days after production is completed. Rural Deliveries may take longer.

LIMITATION OF LIABILITY: In no event shall PrintSale.ca or its suppliers, or vendors, their officers, directors, employees, or agents be liable for any special, incidental, indirect, or consequential damages of any kind, or for any damages whatsoever resulting from loss of use, data, or profits, whether or not PrintSale.ca has been advised of the possibility of damage, arising out of or in connection with the use or performance of the site or of failure to provide products or services that you order from PrintSale.ca or its affiliates, including without limitation, damages arising from mistake, omission, virus, delay, or interruption of service. In no event shall PrintSale.ca be liable or responsible for any damages or consequences arising from or related to your inappropriate or unauthorized use of this site or its content.

INDEMNIFICATION: You agree to indemnify and hold PrintSale.ca and its subsidiaries, officers, agents, affiliates or subcontractors, employees, successors or assigns harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of Content you submit, post to or transmit through the Service, your use of the Service, your connection to the Service, your violation of the Terms of Service, or your violation of the rights of a third party.
